UK Compliance Schemes

Producers may choose to have their collection, treatment, recovery and recycling obligations discharged on their behalf by a compliance scheme. Conversely, some producers may prefer the independence and control of arranging and demonstrating compliance themselves. Both are valid choices.

Compliance scheme services include: arranging registration of members; procuring compliance services (including arrangements for treatment and for recovery and recycling of separately collected WEEE to the target percentages); reporting the evidence to show that obligations have been met and liaising with the relevant authority.

A compliance scheme:

  • Arranges its members' annual registration with the relevant authority.
  • Registers itself annually, with the relevant agency, for the purposes of subsequent enforcement.
  • Notifies the relevant enforcement agency of new members joining and members leaving its scheme.
  • Provides information and data according to formats required.
  • Assume its members' obligations and any penalties arising from non-compliance.
  • Reports the required evidence of compliance on behalf of its members.

A compliance scheme will cover all members' (producers') responsibilities under WEEE including 'financial guarantees'.

Independent Producer Compliance

Producers are able to comply with the requirements of the recovery and recycling elements of the WEEE Regulations themselves. Producers taking an independent route to compliance will need to meet the same requirements as group schemes. This includes the payment of a registration fee (currently £12000 for three years).
